Houston, TX (Law Firm Newswire) August 04, 2022 – Ceja Law Firm PLLC today announced that a Houston Grand Jury refused to indict our client for aggravated assault with a lime squeezer.
The defendant, a 48-year-old homemaker, was with her family at a roadside stand to buy corn in a cup. The complaining witness was also at the roadside stand with her family. The parties had been acquaintances for several years, during which time the alleged victim was antagonistic toward our client and the church community to which she belonged.
According to witnesses, including our client’s husband, the couple purchased corn in a cup and approached the condiment table. The alleged victim blocked our client’s path while taunting her. Our client reached across the alleged victim to grab a lime squeezer to add lime to her corn.
The alleged victim then squeezed a bottle of mayonnaise on our client’s hair and chest, causing her to react by lifting her right hand, which was holding the lime squeezer, and accidentally strike the alleged victim in the head, causing a cut on her nose. Our client was subsequently charged with aggravated assault with a deadly weapon, punishable by up to 20 years in prison, even though the alleged victim did not sustain a serious or permanent injury.
We argued that (1) our client did not intentionally, knowingly, or recklessly commit aggravated assault and (2) a lime squeezer is not a deadly weapon under Texas law. The Grand Jury “no-billed” the case finding no probable cause after we submitted additional evidence and letters of character reference.
